DISCUSSIONS ON THE PENDING JCM SUBJECTS IN THE JCM (DC) STANDING COMMITTEE MEETING HELD IN 23.08.2013

The standing committee meeting of JCM (DC) was held on 23.08.2013 under the chairmanship of Member (O) to discuss the pending items of the last JCM (DC). Com. K. V. Sridharan, Leader Staff side, Com. Giriraj Singh, Secretary Staff Side, Com. M. Krishnan, Secretary General NFPE Com. D. Theagarajan, Secretary General FNPO represented the staff side. Com. Ishwar Singh Dabas, General Secretary, P4 NFPE, Com. T. N. Rahate General Secretary P4, FNPO were also present to discuss the postmen related issues.

The following are the decision in respect of important items.

1. A new chairperson will be nominated with in a fortnight for further continuance of cadre restructuring proposal. A meeting with the staff side will be held within one month.
2. The case of System Assistant will be looked into by the cadre review committee. The uniform duties and other ten demands pertaining to system administrators will be discussed in the same committee.
3. Droping the practice of obtaining fidelity bond will be reviewed once again.
4. The protection of pay of the defunct scale of PO & RMS Accountant case is being reviewed.
5. The revision of cash allowance to the SPMs handling cash in the absence of treasurer will be finalized at the earliest possible.
6. The committee reports for enhancing the line limits for cash remittance will be decided within a month. Providing van for cash conveyance for MNERGA payment will be considered.
7. Fixing of norms to PSD and CSD will be considered only after the implementation of IT modernisation project.
8. Allowing the physically challenged officials to appear in the IP examination, the referred case has not yet been finalized by the department of Social Justice. One more reminder and personal approach to expedite the approval will be made.
9. The revised HSG I Recruitment rules ensuring 100% HSG I Posts to General line is under process. The revised recruitment rules for HSG I will be finalized within two months.
10. The proposal for payment of incentive instead of honorarium for processing PLI/RPLI proposal will be finalized shortly. We pointed out about non-payment of RPLI incentive on monthly basis as per 2009, orders in most of the circles. It was assured to issue instructions to adhere the said instructions scrupulously. We pointed out the inadequate allotment of funds of clearing the pending incentive bills to the field officers and Agents and requested to allot the sufficient fund to wipe out all the pending bills forthwith. This was assured.
11. The proposal for the grant of Excess duty allowance or restoration of charge allowance to the SPMs working in single and Double handed post offices will be considered.
12. The issue regarding the counting of training period for the benefits of promotion under TBOP/BCR scheme as per the court judgment will be considered after getting the law ministry opinion as well as its implementation in respect of U.P circle at first.
13. Holding of examination for the post of AMM in MMS and holding DPC for Dy. Manager MMS will be finalized within two months.
14. The issue of appointment of Superintendent, Sorting in RMS will be finalized shortly.
15. The staff side demanded to record disagreement in respect of the denial of cash handling allowance to treasures at par with cashiers. The chairman inform that we will have one more attempt with MoF. The staff side assured to submit a fresh detailed not above the justification in this case.
16. The committee constituted to discuss about Group ‘B’ promotion under the chairmanship of Shir. V. K. Tiwari DDG (R&P) will finalise its recommendation within one month. The staff side presented our views which is enclosed herewith for the consumption of all comrades.
17. In the issue of anomaly in the preparation of PA gradation list, we insisted whatever settled earlier should not be reopened. This was agreed and DDG (P) assured to give appropriate instruction to Tamilnadu Circle.
18. Orders issued for protection of pay to employees who seek transfer to a lower post under FR 15(a)/under Rule 38.
19. Construction for department building for DPA at Hyderabad. Proposal not agreed. In respect of Trivandrum and Patna, this is under process.
20. Demand fresh establishment review for proposal/revival sanction of peripheral HRA will not be insisted hereafter. Proposal to upgrade the cities for drawal of HRA as per the 2011 census will be take up with MoF.
21. The unjustified three conditions imposed for appearing IP examination for the departmental quota vacancies will be reviewed and modified shortly.
22. The Civil wing Karnataka circle ensured the safety of the existing building at Kodial bail HSG I in Mangalore division and no possibility of new construction. As the accommodation is far below the SOA we insisted for shifting of the PO for a better building which will be examined.
23. The construction work began for the new departmental building at Itanagar HO/North East Circle.
24. The incentive for IMT work will be finalized shortly. The file is new pending with internal finance for approval.
25. The recovery imposed on official for interest paid on PPF Accounts in case of Karnataka circle have been ordered to refund to the officials like Mysore and case settled.
26. In case of fixation of pay for MTS by separate fixation for each MACP has been referred to the nodal ministry for clarification.
27. Taking dies non period for reckoning of continuous service for grant of MACP will be further examined. We pleaded, in the MACP order, there is no qualifying service and it should be on continuous service for grant of MACP and thus all EXOL, dies non period should be taken as service.
28. Orders have been issued with regard to recovery of Postage in case of foreign articles returned due to non availability of service – case settled.
29. Clarification has been issued to fix 1800 grade pay after training for the canteen employees – case settled.
30. The earlier order denying arrears on encashment of earned leave is modified and orders issued to pay the difference in encashment of EL for availing LTC.
31. Orders issued to CPmGs to hold immediate DPCs for filling up of all vacant LSG, HSG II and HSG I.
32. Orders will be issued shortly in relaxing the standard to GDS belonging to SC/ST quota in the appointment of Postal Assistant in the revised PA/SA Recruitment rules. One more instructions will be issue to all circle heads to have a special drive to fill up all the vacancies of PA, Postman etc. kept under residual vacancies.
33. As the finalization revised recruitment rules for PA/SA is delayed due to non clearance by nodal ministries. It is decided to fill up the PA vacancies of circle office as per the existing recruitment rules.
34. Orders issued by promoting the OS as AD recruitment.
35. The earlier instructions will be reiterated in respect of observation of tenure in RMS, HRO and divisional offices.
36. The IP Posts under Direct recruitment in J&K Circle cannot be filled up due to non allotment from UPSC.
37. Clarifications were issued for short drawal of Grade pay in case of pharmacists in P&T dispensary.
38. The recovery effected from the commutation of pension has been stopped as per OM dated 10.02.2009.
39. A module will be finalised by the Directorate within two months for imparting training to the Group ‘D’ selected under Blind Quota for upgradation of their Grade pay to 1800/-
40. A reference will be made to the nodal ministry for the grant of grade pay of Rs. 1800- to MTS who retired/expired from service after 13.08.2008 without having been imparted training.
41. In respect of fixing of norms for postman work, a separate meeting will be held.
42. The revision of double duty allowance is under active consideration.
43. The demand for revision of LR strength as per volume IV has been disputed by the official side by citing the MOF order dated 24.08.1995. we are not accepting and conveyed to come up with full details in the next meeting.
44. A provision will be made in the revised module software in Accounts for online facility of GPF Accounts directly by the officials.
45. Updating Postal manual, Volumes are underway by a special team. It will be fianlised at the earliest possible.
46. The proposal for bifurcation of Bastar Division is considered. The proposal for redeployment of Group ‘B’ posts for creation of separate division is under consideration.
47. All circle heads will be addressed for the timely supply of uniforms to the officials. The staff side is also requested to furnish the details in case of non supply of uniforms to the officials in respect of any circle.
48. Staff side insisted for providing more feeder cadre post in case of PO & RMS. Account line officials and assured to submit a brief note on this for consideration.

 தென் மண்டல (பொறுப்பு)  இயக்குனரின் அடாவடிச் செயல்கள்  மற்றும் ஊழியர் விரோதப்  போக்கினைக் கண்டித்தும் ,

 தென் மண்டலத்தில் மலை போல தேங்கிக் கிடக்கும் ஊழியர் பிரச்சினைகளைத் தீர்க்கக் கோரியும், 

பலமுறை பேசியும் எழுதியும்  இவற்றையெல்லாம்  தட்டிக் 
கேட்கவேண்டிய  மண்டல நிர்வாகம்  தனக்கென்ன என்ற ஏனோ தானோ மனோ பாவத்தில் இருப்பதைக் கண்டித்தும்  

தென் மண்டலத்தில் உள்ள அனைத்துக் கோட்ட/ கிளைகளிலும் எதிர்வரும் 04.09.2013 அன்று மாலை  கோட்ட/ மற்றும் தலைமை அஞ்சலகம் முன்பாக  மாபெரும் கண்டன ஆர்ப்பாட்டம் !

அதே நேரத்தில் மதுரை மண்டல அலுவலகம் முன்பாக மாநிலத்  தலைவர், மாநிலச் செயலர் , மண்டலச்   செயலர்   கலந்து கொள்ளும்  கண்டன ஆர்ப்பாட்டம்   -  
மற்றும்  தென் மண்டல அதிகாரியிடம் கோரிக்கை மனு அளித்தல் !

அன்புத் தோழர்களே ! கடந்த 10.08.2013 அன்று   மதுரையில் நடைபெற்ற தென்மண்டல கோட்ட/ கிளைச் செயலர்கள் கூட்டத்தின் முடிவின் படி தென் மண்டல (பொறுப்பு)  இயக்குனரின் அடாவடி நடவடிக்கைகளை கண்டித்தும்,   தேங்கிக் கிடக்கும் பிரச்சினைகளைத்  தீர்க்கக் கோரியும், முதற் கட்டமாக   கண்டன ஆர்ப்பாட்டம் நடத்தி தென்  மண்டல   PMG அவர்களிடம்கோரிக்கை  மனு அளிப்பதென்றும், அதே நேரத்தில்  தென் மண்டலத்தில் உள்ள அனைத்து கோட்ட/ கிளைகளிலும் அவரவர் பகுதியில் உள்ள கோட்ட/ தலைமை அஞ்சலக வாயிலில் கோரிக்கைகளை வலியுறுத்தியும்  தென் மண்டல  (பொறுப்பு ) இயக்குனரின் அடாவடி நடவடிக்கைகளை கண்டித்தும்  கண்டன ஆர்பாட்டம் நடத்துவதெனவும்  முடிவு எடுக்கப் பட்டது தெரிந்ததே .   

இதன் படி  அளிக்கப் படும் கோரிக்கைகள்  மீது பேச்சு வார்த்தை நடத்தி 15 நாட்களுக்குள்   பிரச்சினைகள் தீர்க்கப் படாவிட்டால் தொடர் போராட்டங்கள் நடத்துவது என்றும் தீர்மானிக்கப் பட்டதும்  நாம் அனைவரும் அறிவோம்!

எனவே இந்த முடிவை அமல் படுத்திட  எதிர்வரும் 04.09.2013 அன்று  தென் மண்டல PMG  அவர்களிடம் கோரிக்கை மனு அளிக்கப் பட வுள்ளது. கோட்ட/ கிளைச் செயலர்கள் கூட்டத்தில் கூறிய படி இதுவரை 11 கோட்ட/ கிளைச் செயலர்களிடமிருந்து மட்டுமே  தேங்கிக் கிடக்கும் பிரச்சினைகள் மாநிலச் சங்கத்திற்கு வந்துள்ளது.  மீதியுள்ள கிளைகளில்  இருந்து எதிர்வரும் 27.08.213 க்குள்  வந்து சேருமாறு E-MAIL  மூலம்  பிரச்சினை களை  மாநிலச் சங்கத்திற்கு அனுப்பிட  கோருகிறோம்.  தென் மண்டலத் தில் உள்ள மாநிலச் சங்க நிர்வாகிகள் உடனே  இதில் கவனம் செலுத்தி பிரச்சினைகளை பெற்று மாநிலச் செயலருக்கு அனுப்பிடக்கோருகிறோம்.

அனைத்து கோட்ட/ கிளைகளில் இருந்தும் இந்தப் போராட்டம் குறித்து உடன் நோட்டீஸ்  வெளியிட்டு அதன் நகலை  மண்டல PMG , மாநில CPMG மாநிலச் செயலர் ஆகியோருக்கு  உடன் அனுப்பிட வேண்டுகிறோம். எந்தக் கிளையில் இருந்தும்  நோட்டீஸ் வெளியிடாமல் இருந்துவிடக் கூடாது. 

இதன் பொறுப்புகளை மண்டலத்தில் உள்ள மாநிலச் சங்க நிர்வாகிகள் மேற்கொள்ள வேண்டுகிறோம்!

மாநிலச் சங்கத்தில் இருந்து கோரிக்கை மனு மற்றும் விரிவான நோட்டீஸ் விரைவில் வெளியிடப் படும் !

Aadhaar Card as Address Proof

Reserve Bank of India (RBI) has notified that the Aadhaar Card is a valid proof for opening of a bank account under the Know Your Customer (KYC) scheme. 


RBI vide its circular dated 28.09.2011 has advised banks to accept the Aadhar letter issued by Unique Identification Authority of India (UIDAI) as an officially valid document for opening bank accounts without any limitations applicable to small accounts. Further, the RBI has also advised the banks vide its circular dated 10.12.2012 that if the address provided by the account holder is the same as that on Aadhaar letter, it may be accepted as a proof of both identity and address. 

This was stated by Shri Namo Narain Meena, MoS in the Ministry of Finance in written reply to a question in the Lok Sabha.

DOPT Orders 2013 - Dopt issued clarifications as FAQ on Recruitment Rules

Department of Personnel and Training issued orders and clarification regarding all service matter from time to time. In that respect, seeking clarifications from various departments and ministries about ‘Recruitment Rules’, Dopt has clarified by the way of ‘Frequently Asked Questions’. This is the better way to know the rules and regulations abut the subject.  [Dopt order No. AB.14017/13/2013-Estt. (RR) (1349) dated on 6.3.2013]

FAQs on Recruitment Rules
1. What are Recruitment Rules? 
Ans. Recruitment Rules are rules notified under proviso to Article 309 or any specific statutes for post(s) prescribing inter alia the method of recruitment and eligibility for such recruitment. It contains notification part having substantive rules and schedule part (as per prescribed Annexure-I). Recruitment Rules are subordinate legislation and so, they are statutory in nature.

2. What are Service Rules? 
Ans. Service Rules are Recruitment Rules for any of the Organized Central Services covering many aspects including constitution of the Service, seniority, probation and other conditions of service.

3. Whether Recruitment Rules are applicable retrospectively? 
Ans. The legal position is that the posts are to be filled up as per the eligibility conditions prescribed in the Recruitment Rules in force at the time of concurrence of vacancies unless the Recruitment Rules are amended retrospectively. The practice has however been to give effect to the Recruitment Rules prospectively.

4. Why are Recruitment Rules framed? 
Ans. As soon as decision is taken to create a new post/ service to upgrade any post or re-structure any service, the Recruitment Rules/ Service Rules are framed. Any post is filled up as per the provisions of the Recruitment Rules/ Service Rules.

5. Why are Recruitment Rules amended? 
Ans. Revision in the Recruitment Rules is made by way of amendment to incorporate changes due to implementation of Central Pay Commission Report,  modification of orders/ instructions on the subject, creation/ abolition of posts  etc. during the intervening period. 

6. How Recruitment Rules are framed/ amended? 
Ans. Recruitment Rules for Group ‘A’ & 13′ posts/ service are framed/  amended by the administrative Ministry/Department in consultation with  Department of Personnel & Training, Union Public Service Commission and  Ministry of Law (Legislative Department) and approval of competent authority in the Ministry/ Department to be obtained.

7. Why and how are Recruitment Rules relaxed? 
Ans. The power to relax clause in the Recruitment Rules/ Service Rules provides the authority to relax the rules in respect of class or category of person. The administrative Ministry/ Department may resort to relaxation of the rules in consultation with Department of Personnel & Training and Union Public Service Commission.

8. Who is competent authority to frame/amend the Recruitment Rules? 
Ans. All Recruitment Rules including their amendments should be approved at the level of Minister-in-charge, unless the Minister has by general or special  order delegated such approval at a lower level(s).

9. Who is competent authority to frame/amend the Recruitment Rules of Group ‘C’ posts? 
Ans. Administrative Ministries/ Departments are empowered to frame / amend the Recruitment Rules in respect of Group ‘C’ posts keeping in view the guidelines/ Model Recruitment Rules issued by this Department on various aspects. In case of deviation from existing guidelines/ Model Recruitment Rules, the concurrence of Department of Personnel & Training is to be obtained.

10. Who is competent authority to relax the Recruitment Rules of Group ‘C’ posts? 
Ans. The Ministries/ Departments are competent to relax the Recruitment Rules for Group ‘C’ posts. The provisions governing upper age limit or  qualifications for direct recruitment should not however be relaxed without prior concurrence of Department of Personnel & Training.

11. What is the format/ procedure to send the proposal for consultation with Department of Personnel & Training for framing/amendment of Recruitment Rules? 
Ans. Proposal for framing/ amendment of Recruitment Rules for Group ‘A’ & Group ‘B’ posts (except Service Rules) is sent to Department of Personnel & Training, first, on-line under Recruitment Rules Framing Amendment and  Monitoring System (RRFAMS) of the on-line services of Department of  Personnel & Training. After approval of on-line Recruitment Rules in  Department of Personnel & Training, the proposal is referred by the Administrative Ministry/ Department in a file with a self-contained note accompanied inter alia the following: – 
(i) Check-list for sending proposal to Department of Personnel & Training. 
(ii) Copy of the report of freezed on-line Recruitment Rules. 
(iii) Draft Recruitment Rules including notification and Schedule 1 (for posts other than those in the Organized Services) in the proform in Annexure I. 
(iv) Supporting particulars in Annexure II (for framing of Recruitment Rules) Annexure-III (for amendment of Recruitment Rules), as prescribed in Department of Personnel & Training OM No. AB.14017/48/2010-Estt. (RR) dated 31.12.2010. 
(v) Recruitment Rules for the feeder posts(s) and the higher post, if any, 
(vi) Present sanctioned strength of the post for which rules are being framed/ amended as also of the lower and higher posts.

12. What are model Recruitment Rules? 
Ans. Model Recruitment Rules for a number of common categories of posts have been framed in consultation with Union Public Service Commission, wherever required. While framing/ amending Recruitment Rules for such posts, the model rules should be adhered to.

13. What is procedure for consultation with Union Public Service Commission? 
Ans. After obtaining the concurrence of the Department of Personnel & Training, the Administrative Ministry / Department should refer the draft Recruitment Rules for posts / services which are within the purview of the Union Public Service Commission in a self-contained letter to the Commission, along with the information in the prescribed proforma (Check list, Annexure II/ Annexure-III etc.). It should be stated in the letter to the Commission whether the clearance of the Department of Personnel & Training (and also the Department of Pension & Pensioners’ Welfare were required) has been obtained in respect of the proposals in question.

14. What is initial constitution clause in Recruitment Rules? 
Ans. In cases where a new service is formed and the Recruitment Rules are framed for the first time and that there are officers already holding different categories of posts proposed to be included in the service on a regular / long term basis, a suitable ‘Initial Constitution’ Clause may be inserted in the Notification so as to count the regular service rendered by such officers before the date of notification of the Rules.

15. Whether reservation, relaxation of age limit and other special categories of persons are applicable in Recruitment Rules? 
Ans. These concessions in recruitments are made applicable by inserting the following ‘Saving Clause’ in the covering notification of the Recruitment Rules:- 
"Nothing in those rules shall affect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard".

16. What is the schedule in Recruitment Rules? 
Ans. The schedule of Recruitment Rules of post(s) is a 13 columns table as per prescribed Annexure-I (vide OM No. AB-14017/48/2010-Estt. (RR) dated 31.12.2010) containing details of the post(s) along with method of recruitment and eligibility criteria. The prescribed schedule is used for post() which are not covered by any organized service.

17. What is notification part of Recruitment Rules? 
Ans. Notification of Recruitment Rules contains the substantive rules which  include the provisions related to title, date of commencement, enabling provision for applicability of schedule, disqualification clause, power to relax clause, saving clause and any other rule specific to a post viz. initial constitution clause, liability for all-India Service etc.

18. What are the upper age limits prescribed for Direct Recruitment? 
Ans. The upper age limits for different posts depend upon the nature of duties, educational qualifications and experience requirements as prescribed in this Department OM No. AB-14017/48/2010-Estt (RR) dated 31.12.2010 (Para 3.7.4.1 & 3.7.4.2).

19. What are relaxations available for upper age limit in direct Recruitment Rules? 
Ans. A provision is prescribed in the recruitment rules for relaxation of the upper age-limit for departmental candidates up to 40 years for appointment by direct recruitment to Groups C posts and for Government servants up to 5 years for direct recruitment to Groups A and B posts:

20. How to calculate crucial date for age limit? 
Ans. In the case of recruitment through the Union Public Service Commission and the Staff Selection Commission, the crucial date for determining the age- limit shall be as advertised by the UPSC / SSC. In the case of other recruitment, the crucial date for determining the age-limit shall be the closing date for receipt of applications from candidates in India (and not the closing date prescribed for those in Assam etc.).

21. How is the educational and other qualification required for direct recruit fixed? 
Ans. The minimum educational qualifications and experience required for direct recruitment may be indicated as precisely as possible and if necessary, into two parts, viz., "Essential Qualifications" and "Desirable Qualifications" taking into account the pay band/ grade pay and the nature of duties, and the provisions in  the approved Recruitment Rules for similar higher and lower posts in the same hierarchy.

22. Whether the educational qualifications prescribed for direct recruits are applicable to promotees? 
Ans. The educational qualifications are not generally insisted upon in the case of promotion to posts of non-technical nature; but for scientific and technical posts, these should be insisted upon, in the interest of administrative efficiency, at least in the case of senior Group A posts in the Pay Band-3 Grade Pay Rs. 6600 and above. Sometimes the qualifications for junior Group A posts and  Group B posts may not be insisted upon in full but only the basic qualification in the discipline may be insisted upon.

23. Whether any age limit prescribed for promotion? 
Ans. Unless there are any specific grounds, the age limit prescribed for direct recruits are not insisted upon in the case of promotees.

24. When probation for appointment to a post/service in Central Government is prescribed? What is the duration of probation? 
Ans. The probation is prescribed when there is direct recruitment, promotion from one Group to another e.g. Group B to Group A or officers re-employed before the age of superannuation. There will be no probation for promotion from one grade to another but within the same group of posts e.g. from Group ‘C’ to Group ‘C’ and for appointment on contract basis, tenure basis, re-employment after superannuation and absorption. The period of probation is as prescribed in  this Department OM No. AB-14017/48/2010-Estt (RR) dated 31.12.2010 (Para 3.10.1 & 3.10.2).

25. What are the methods of recruitments? 
Ans. The different methods of recruitment are: 
(a) Promotion 
(b) Direct Recruitment 
(c) Deputation 
(d) Absorption 
(e) Re-employment 
(f) Short-term contract

26. How is the method of recruitment or percentage of vacancies to be filled by various methods of recruitment decided? 
Ans. The percentage of vacancies to be filled by each method that may be prescribed for a particular post or Service depend on a judicious blending of several considerations, e.g., 
(i) the nature of duties, qualifications and experience required: 
(ii) the availability of suitable personnel possessing, the reequisite qualifications and experience within a cadre. 
(iii) The need for ensuring that suitable incentives exist for the maintenance of an adequate standard of efficiency in the cadre; 
(iv) Consideration of the question whether, having regard to the role to be performed by a specified cadre or Service, it is necessary to provide for direct intake of officers at an appropriate level with a view to injecting fresh knowledge and experience that may not be normally available in a  particular Service or Department etc. 
(v) The proper mix of the six methods of recruitment i.e. (a) promotion (b) direct recruitment (c) deputation (d) absorption (e) re-employment (f) short-term contract (mentioned at (a) to (f) above).

27. What is promotion? 
Ans. Promotion is method of recruitment from feeder grade post(s) to higher post in the hierarchy as per the provisions of the Recruitment Rules. If promotion is kept as a method of recruitment, it is also necessary to lay down the number of years of qualifying service before the persons in the field become eligible for promotion. Only regular, and not ad hoc, period of service is taken into account for purposes of computing this service.

28. What is Direct Recruitment? 
Ans. Direct recruitment is the recruitment which is open to all candidates, eligible as per the provisions regarding age, educational qualification/ experience etc. as prescribed in Recruitment Rules.

29. What is Deputation? 
Ans. Deputation is a method of recruitment where officers of Central Government Departments or State/ UT Governments from outside are appointed to post(s) in Central Government for a limited period, by the end of which they will have to return to their parent cadres. In case of isolated post, it is desirable to keep the method of recruitment of deputation/ short term contract as otherwise the incumbents of such posts, if directly recruited, will not have any avenue of  promotion/ career progression.

30. What is short term contract? 
Ans. Short term contract is also a form of deputation where officers from non- Government bodies e.g. universities, research institutions, public sector undertakings for teaching, research, scientific and technical post(s) can some to Central Government posts.

31. Whether absorption and Deputation are synonymous? What is absorption? 
Ans. Absorption and deputation are not synonymous. There is a substantial difference between absorption and deputation. Under the provision absorption, the officer, who initially comes on deputation, may be permanently absorbed in  the post/ grade if recruitment rules prescribe for absorption as mode of  recruitment. Such absorption can be effected only in the case of officers who are on deputation from the Central / State Government.

32. What is composite method of recruitment? 
Ans. In cases where the field of promotion or feeder grade consists of only one post, the method of recruitment by "deputation (including short-term contract) /  promotion" is prescribed so that the eligible departmental officer is considered  along with outsiders. If the departmental candidate is selected for appointment to the post; it is to be treated as having been filled by promotion; otherwise, the post is to be filled by deputation / short-term contract for the prescribed period of deputation / short-term contract at the end of which the departmental officer will  again be afforded an opportunity to be considered for appointment to the post. 
  
33. How is field of deputation decided? 
Ans. The field for "deputation/ short-term contract/ absorption should, as far as possible, consist of officers holding analogous posts on regular basis but may be widened to include officers working in the next lower grade also with the qualifying service on regular basis normally prescribed for promotion.

34. How is the period of qualifying service for promotion decided? 
Ans. The qualifying service for promotion from one grade to another is necessary so that there is no premature promotion or undue jump in pay and also  to ensure that the officer has sufficient opportunity to demonstrate his  competence/potential for holding the higher post. The period of qualifying service varies from post to post depending upon the scale of pay and the  experience, required for manning the higher post. Broadly, the following qualifying service to be followed is prescribed in this Department OM No. AB-  14017/48/2010-Estt (RR) dated 31.12.2010 (para 3.12.2).

35. What is the maximum age limit for Deputation? 
Ans. The maximum age limit for appointment on deputation including short term contract) or absorption shall be not exceeding 56 years as on the closing date of receipt of applications.

36. What is the crucial date for determination of eligibility of absorption/  deputation? 
Ans. The guidelines for crucial date for determination of eligibility for absorption/ deputation are as follows :- 
(i) In the case of a vacancy already existing at the time of issue of the communication inviting nominations, the eligibility may be determined with reference to the last date prescribed for receipt of nominations in the Ministry/ Department/ Organization responsible for making appointment to the post i.e. originating Ministry etc. 
(ii) In the case where a vacancy is anticipated, the crucial date for determining eligibility should be the date on which the vacancy is expected to arise.

37. How is Departmental Committee formed? 
Ans. When promotion is kept as a method of recruitment, the detailed composition of the Departmental Promotion Committee, with minimum 3  officers, may be indicated. In the case of promotion to Group `A’ posts, the  Union Public Service Commission shall also be associated. The total strength of DPC including Chairman need not necessarily be an odd number as the decision is to be taken as a joint one.

38. What are the circumstances in which Union Public Service Commission  is to be consulted for recruitment? 
Ans. UPSC is required to consult in case of recruitment to all Central Civil  Services and Central Civil Posts. Exemption from Consultation with Union  Public Service Commission is governed by the Union Public Service Commission (Exemption from Consultation) Regulations, 1958 as amended  from time to time and the Central Civil Services and Civil Posts (Consultation  with Union Public Commission) Rules, 1999 as amended. Some of the circumstances in which the Union Public Service Commission are to be  consulted in making recruitment to the posts are illustrated below:- 
(i) Direct Recruitment, 
(ii) Re-employment, 
(iii) Absorption, 
(iv) Composite method of recruitment ( i.e. where the departmental candidate is to be considered along with outsiders), 
(v) In case of deputation — (a) if the field for consideration includes State Government Officers or Group ‘A’ & ’13′ officers of the Central Government simultaneously and (b) if the field for consideration consists  
of not only Central/State Government officers but also officers from non- Government institutions 
(vi) Any relaxation or amendment of the provisions of the Recruitment Rules.

39. Whether recruitment to a post can be made in absence of recruitment rules of a post? 
Ans. If there are overriding compulsions for filling any Group or Group B post in the absence of Recruitment Rules, then the Ministries/ Department may make reference to Union Public Service Commission for determination of  method of recruitment as a onetime measure for filling up of a post on regular basis.

40. What are the limits for notification of Recruitment Rules? 
Ans. The Recruitment Rules or amendment(s) thereto as finally approved by the Union Public Service Commission are required to be notified within a period  of 10 weeks from the da of receipt of their advice letter. This time limit should  be strictly adhered to.

41. What needs to be done in case where posts are transferred to some other Ministries/Departments? 
Ans. The Ministry/Departments concerned should mutually agree for transfer of the posts and the same should be concurred by Department of Expenditure. Thereafter, the existing RR needs to be de-notified in consultation of Department  of Personnel & Training, Union Public Service Commission and Ministry of Law. Suitable recruitment rules in the transferred Department may be framed/  amended following due procedure.

Retirement age 62 – No hike in Retirement age of Central Government employees…

CENTRAL TRADE UNIONS HELD NATIONAL WORKERS CONVENTION
AT NEW DELHI ON 06TH AUGUST 2013

A massive National convention of all Central Trade Unions, Central and State Government Employees & Teachers Federations and Public Sector employees Unons etc was held at Mavlankar Hall New Delhi on 6th August 2013. The convention was addressed by the leaders of BMS, INTUC, AITUC, CITU, HMS, AIUTUC, TUCC, SEWA, AICCTU, UTUC, LPF. Presidium consisted of the leaders of all the above Central Trade Unions. The resolution adopted by the National convention called upon the workers to organize following.

1. Demonstration/Rallies/Satyagraha at all state capitals with respective statewide mobilization on 25th September 2013
2. Massive Demonstration before Parliament with main mobilization from neighbouring states on 12th December, 2013
3. On the same day of Demonstration before Parliament (12th December 2013), District-level Demonstrations at all District Headquarters all over the country.
4.  Sectoral programme of joint actions for effectively opposing Restructuring, Outsourcing etc. and on sector-specific issues/demands and against Divestment of shares in Pubic Sector Enterprises.
5.  Exclusive Joint Action Programmes on the demand of Minimum Wage and Contract Workers related other demands.

Clarification regarding admissible non-admissible items under CGHS

OFFICE MEMORANDUM 

Subject : Clarification regarding admissible non-admissible items under CGHS

With reference to the above mentioned subject the undersigned is directed to draw attention to the Office Memorandum of even number dated 1st October 2012 issued by this Department in compliance of the directions of Hon'ble High Court of Delhi in the case of Shri Kanhiya Singh Vs U01 and others [W.P.(C) 9044/2011] clarifying admissibility / inadmissibility of items of expenditure for claiming reimbursement under CGHS. The same are being reproduced for a wider circulation and information in compliance of Hon'ble High Court's latest direction issued on 16.05.2013 in this case. The requisite clarifications regarding admissible and non- admissible items under CGHS are provided herewith as under:-

a) "CGHS Package Rate" shall mean and include lump sum cost of inpatient treatment / day care / diagnostic procedure for which a CGHS beneficiary has been permitted by the competent authority or for treatment under emergency from the time of admission to the time of discharge including (but not limited to) — (i) Registration charges, (ii) Admission charges, (iii) Accommodation charges including patients diet, (iv) Operation charges, (v) Injection charges, (vi) Dressing charges, (vii) Doctor / consultant visit charges, (viii) ICU / ICCU charges, (ix) Monitoring charges, (x) Transfusion charges, (xi) Anesthesia charges, (xii) Operation theatre charges, (xiii) Procedural charges / surgeon's fee, (xiv) Cost of surgical disposables and all sundries used during hospitalization, (xv) Cost of medicines, (xvi) Related routine and essential investigations, (xvii) Physiotherapy charges etc. (xviii) Nursing care and charges for its services.

b) Cost of Implants / stents / grafts is reimbursable in addition to package rates as per CGHS ceiling rates for Implants / stents / grafts or as per actual, whichever is lower, in case there is no ceiling rate prescribed under CGHS,

c) During In-patient treatment of the CGHS beneficiary, the hospital will not ask the beneficiary or his / her attendant to purchase separately the medicines / sundries / equipment or accessories from outside and will provide the treatment within the package rate, fixed by the CGHS which includes the cost of all the items.

d) In cases of conservative treatment / where there is no CGHS package rate, the above mentioned items are admissible-items wise at CGHS rates or as per AIIMS rates (if there is no CGHS rate) or as per actual (if there is no CGHS / AIIMS rate) available for any item.

e) Package rates envisage up to a maximum duration of indoor treatment as follows:
12 days for Specialized (Super Specialties) treatment;
7 days for other Major Surgeries;
3 days for Laparoscopic surgeries / normal deliveries; and
1 day for day care / Minor (OPD) surgeries.


However, if the beneficiary has to stay in the hospital for his / her recovery for a period more than the period covered in package rate, in exceptional cases, supported by relevant medical records and certified as such by hospital, the additional reimbursement shall be limited to accommodation charges as per entitlement , investigations charges at approved rates, and doctors visit charges (not more than 2 visits per day per visit by specialists / consultants) and cost of medicines for additional stay).
No additional charge on account of extended period of stay shall be allowed if that extension is due to infection on the consequences of surgical procedure or due to any improper proceed.


f) In addition to the above mentioned items, some patients may require additional facilities/ procedures, which are admissible with proper justification in deserving cases. Therefore, it is not possible to give a comprehensive list of items, which are not admissible.
However, the following items are not admissible: 
Telephone charges
Toiletries
Sanitary napkins 
Talcum powder 
Mouth fresheners

2. It has also been decided to clarify that expenses incurred on medicines, consumables, sundry equipments and accessories etc., which are purchased from outside, based on specific authorization of treating doctor / staff of the concerned hospital will be reimbursable if they are not falling under the list of non-admissible items. In case the empanelled hospital has asked a CGHS beneficiary for purchase of the said items over and above the package rates, reimbursement shall be made to the beneficiary and the amount shall be recovered from the pending bills of hospital.
